ISLAMABAD, Jul 10 (APP):The election tribunal of Islamabad on Wednesday directed the returning officer to submit record regarding uploading of form-45 on website in a petition challenging election results of NA-47.
Election Tribunal Judge Justice Tariq Mehmood Jahangiri heard the case wherein MNA Tariq Fazal Chaudhry’s lawyer informed the court that they have submitted forms 45, 46 and 47.
The lawyer prayed the court to declare the case as non-maintainable and said that they have move an application in this regard. He said that section-145 of the election act has granted the power of suo-moto to election tribunal, adding that it could also dismiss the plea.
Election Commission of Pakistan’s (ECP) lawyer adopted the stance that EMS was not a separate record rather it was a system which was supposed to operate electronically.
The presiding officer had to upload a picture on system after taking it, he said, adding that the EMS system was with the RO not the presiding officer. He said that form 47 is generated itself after uploading data on EMS. The PO sent the forms physically to RO.
The bench sought the record from RO and adjourned the case till July 15.
